I had an original loan with countrywide also that was transferred to BofA when they took over countrywide. My husband and I were a victim of the recession, and my husband is a carpenter who was layed off for almost a year. Unfortunately, we became 2 months behind on our mortgage. We were offered help by BofA, with an offer of a loan modification. We took them up on the offer, turned in all required paperwork on time, and were told that we did qualify for a remodification. We signed all the paper work, sent it back to BofA. We then waited. I was told by BofA that the modification needed to be entered into BofA's computer program, and due to the huge amount of remodification applications, that it would take several months to see it go through, and for us to see it on our statements. For over 1 and a half years, I called several times a month, only to be told that yes the modification was approved, and to keep making the new loan payment amount that we were approved for. Almost 2 years went by, and hundreds of calls later to find out when we would see it on our statement, we got a certified letter that they were foreclosing on our house because we were 11 months behind on our payments. 11 months, because we made the new payments they told us to make. I called like you did. Almost everyday I got a different person, who never could tell me what they did wrong. After developing ulcers, becoming depressed, crying all the time, worrying that we would loose our home, I contacted our Attorney General of AZ, and got help from legal aid. It took my lawyer from legal aid over a year to get them to agree to keep the terms of our modification. It has ruined our credit, because although I made payments on time every month, they never entered the modified loan. It has been a freaking nightmare, and I can't do a thing about my credit. Our lawyer said that BofA will never admit fault. Were finally making the original modified loan amount, but our credit is screwed because of them. I truly understand what you've been through, just don't give up. Use your voice, and go to the media, your Attorney General, Legal Aid, and anyone else who will listen. I think that reaching out to the media and creating negative publicity might help BOA to listen to you and get the situation solved. It is terrible that there are so many foreclosures lately, especially when people are making their payments on time . Document each payment. Keep trying to speak to supervisors on your calls, every time you talk to anyone always asked to speak to their supervisor. The higher up the chain the better. The CEO if you can get to him. No one explains that Home...Oh Lisa I feel for you. No one explains that Homeowners Insurance is different than Mortgage Insurance. Also Mortgage Insurance is not what it is cracked up to be. Homeowners insurance covers you for fire and those kind of things. Mortgage insurance is insurance for the bank and does not protect the consumer at all. I found this out when my husband passed away thinking we had mortgage insurance to cover us in case of death. Well when I was served with the forclosure papers I contacted my attorney and was explained that mortgage insurance is for the bank in case we, you, I, can't make payments the home goes into foreclosure and the bank then cashes in the insurance to get the balance of monies due them AND they take your home also. So the bank makes out 3 times, one from the consumer because what you are paying most in the first 15 years is interested, second they get their money from the insurance company and third when they foreclose and resell the house. Yes usually this premium is tacked on to the mortgage payment and there is an escrow for this premium. The only time there isnt a mortgage insurance is when you request that the bank come out and appraise your home and if the value is more than 50% of what you owe usually you can drop it, but there is a fee, usually $200.00 for them to re avaluate your home. There is a new federal agency that was created to help citizens who have problems like yours. You can file a complaint with them. It is the Consumer Financial Protection Bureau. I thought of two things I didn't see you mention. 1) write letters to your state and federal representatives and senators with cc: to BOA/RCS; 2) write letters to the banking commission with cc: to BOA/RCS. The other thing that occurred to me was our local news station has a helping hand number for problems that companies refuse to resolve. They will get involved and help and then do a story on the situation. You might was to check and see if any of your local tv/radio/print media offer any kind of program like that. Another thing that just occurred to me as I am writing this, after reading several comments from people who have had the same experience with BOA. a class action law suit is also an option. Just some thoughts.
